Chapter 27: USCIS Approves EB-5 Offering for EVelution Energy's Cobalt Facility

On September 30, 2026, U.S. Citizenship and Immigration Services approved the Form I-956F for Intermestic EB5 Fund II, LP, the $64.8 million EB-5 offering that finances EVelution Energy's solar-powered cobalt processing facility in Yuma County, Arizona.‍ ‍

With the approval, USCIS has reviewed and accepted the project's business plan, economic analysis and offering documents.

Why this project matters

Cobalt is a critical mineral used in EV and drone batteries, jet engines and defense systems, and most of the world's refined cobalt is processed in China. EVelution's Yuma County facility brings that capability back to the United States. Solar construction began in June 2026, and EVelution has signed a five-year offtake agreement with Mitsui & Co. for its planned cobalt metal production.

Offering highlights for accredited investors

• $64.8 million EB-5 offering with 81 investor positions
• $800,000 minimum investment while the project's High Unemployment Area designation lasts, through December 12, 2026
• 9% annual return to investors under the offering terms
• The EB-5 project is projected to create more than 3,300 jobs

EB5 Horizon is proud to work alongside Intermestic Capital on this project.

"Economic security is national security," said Marco A. López, Jr., founder of Intermestic Capital. "In an era of rising global conflict, America cannot build the engines, missiles and munitions that defend it while depending on a strategic rival for the materials that make them work. I have spent my career at the intersection of investment and security, as Chief of Staff of U.S. Customs and Border Protection and as Director of the Arizona Department of Commerce, and I have rarely seen a project that serves both so directly. This facility brings that capacity home, and USCIS approval tells the world it is ready."
